What are the CMS requirements?
Set to go into effect on October 1, 2022, the CMS Final Rule 2023 will require all Medicare and Medicaid marketing calls to be recorded and stored.
As NAHU states in their podcast, “the requirement is that any telephonic marketing must be recorded. When they define marketing, they consider ‘enrollment’ marketing.”
While the intricacies of the law, including which types of agencies this law actually applies to and the definition of marketing, are still being figured out, we recommend reviewing your process for recording and storing phone conversations with your clients and prospects.
