The Centers for Medicare & Medicaid Services (CMS) mandates that life and health insurance brokers obtain a “consent to contact” before assisting with Marketplace plans. In essence, brokers must have permission from individuals, employers, or employees before helping with tasks like searching for applications, aiding in coverage application, enrolling in qualified health plans, or updating coverage details. An attestation form confirms that the information provided on a consumer’s ACA application is correct and true before it is submitted.

How to generate ACA Consent and Attestation Forms
If ACA Consent Forms have been enabled and configured, you’re ready to start generating consent and/or attestation forms.
ACA Consent Form
For a Sales Record
- Go to a Sales Record and select the ‘Generate ACA Forms’ button.
- Choose the default language: English or Spanish.
- This selection determines which email template AMS+ will send to the lead (English or Spanish).
- Pick and choose a user in the ‘Agent’ field dropdown.
- Pick a date .
- Review your rep, agency, and record information and submit when ready.
- The rep information is pulled from the user you selected in the ‘Agent’ field dropdown. Forms can only be generated if the selected user has a phone number and NPN number. If this information is missing, reach out and have that person add it in their My Account > SOA / ACA Consent settings.
For an Individual Record
- Go to the Individual List and open the Individual Record you want to send an ACA Consent Form to.
- Select the ‘Sales’ link at the top of the record and choose ‘ACA Forms’ in the dropdown menu. Alternatively, go to the Consent tab and select Create New > ACA Forms.
- Sales menu:

- This selection determines which email template AMS+ will send to the lead (English or Spanish).
- In the form dropdown, select the 'ACA Consent' option.
- Pick and choose a user in the ‘Agent/User’ field dropdown.
- Pick a date.
- Select the 'Send ACA Email' button when ready.
- AMS+ will immediately send an email with a link to a unique ACA Consent Form to the record's email address. The lead or their authorized representative can sign and submit the form.
ACA Attestation Form
For a Sales Record
- Go to a Sales Record and select the ‘Generate ACA Forms’ button.
- Choose the default language: English or Spanish.
- This selection determines which email template AMS+ will send to the lead (English or Spanish).
- Select the Form dropdown field and choose the ‘ACA Attestation’ option.
- Pick and choose a user in the ‘Agent’ field dropdown.
- Pick a date .

How to text a consent or attestation form
ACA Consent and Attestation Forms are initially generated and sent out via email by default. If the record has a valid cell phone number, you can also deliver the form over an SMS text message.
To text either form, go to the record’s Consent tab and find the form you want to text. Unsigned forms will have a ‘Requested’ status. Select the ‘Text’ button to open the Send Text Message modal and start drafting the message.

The message will automatically populate with the necessary verbiage and a link to the consent or attestation form. Review and edit as you see fit. When ready, select the ‘Send Message’ button to send the text.
How to track consent/attestation form status
After sending out a consent or attestation form, you’ll want to know as soon as it's signed and completed so you can move ahead with your business processes. You can monitor the form’s completion status on the record's Consent tab.
Common questions
What information is needed for consent?
The Centers for Medicare & Medicaid Services (CMS) does not prescribe a standard format or process for obtaining consent or for maintaining this record, so you have the flexibility to determine how you will meet the consent requirement.
As a general rule, however, the record of the consent should include the following information:
- The individual’s, employer’s, or employee’s name
- The date the consent was given
- The name of the agent(s) or broker(s) to whom consent was given
How long do I need to store consent information?
A record of consent does not expire except at the request of the individual, employer, or employee. However, obtained records must be securely stored and accessible for a minimum of ten (10) years.
